A社は発明した製品について、日本に意匠出願を行いました。その後、日本の出願を基礎として、パリ条約の優先権を主張し、他国に意匠出願したいと考え、書類の準備に関して、弊所に相談がありました。
解決策の提案
優先権とは、ある国で意匠出願した際、他の国でも同じ意匠を出願する際に、最初の出願を基準にして新規性や先願の判断を行う制度です。意匠の場合、最初の出願から6ヶ月*以内に他の国で出願すれば、最初の出願日が基準日として扱われます。
*特許及び実用新案は出願から12ヶ月、意匠及び商標は出願から6ヶ月です。
出願時の必要書類の中に、優先権証明書というものがあります。優先権証明書は世界知的所有機関（WIPO）で電子データを提供するシステム（デジタルアクセスサービス「DAS」）があり、そのシステムを利用する国（参加庁）は、書面の提出を省くことができます。
ただ、今回は参加庁ではない国への出願であったため、日本の特許庁へ優先権証明書を取り寄せ、さらに翻訳文を作成する必要がありました。そこで、弊所にて翻訳し、準備を進めました。

About priority certificates
1. Content of the consultation
Company A filed a design application in Japan for a product it invented. After that, the company wanted to file design applications in other countries, claiming priority under the Paris Convention based on the Japanese application, and consulted our firm regarding the preparation of the documents.
2. Solution
Priority is a system in which when a design application is filed in one country, the first application is used as the basis for determining novelty and prior application when the same design is also filed in another country. In the case of a design, if an application is filed in another country within six months* of the first application, the first application date is treated as the base date.
*For patents and utility models, the base date is 12 months from application, and for designs and trademarks, the base date is six months from application.
One of the documents required at the time of application is a priority certificate. The World Intellectual Property Organization (WIPO) has a system (Digital Access Service “DAS”) that provides electronic data of priority certificates, and countries (participating offices) that use this system can omit the submission of paper documents.
However, since this application was filed in a country that is not a participating office, we had to obtain a priority certificate from the Japan Patent Office and also have it translated. Therefore, we translated it at our office and proceeded with the preparations.
