1. Content of the consultation
Company A has developed a new tableware and is considering filing a patent application. The company asked us to know the situation of other companies when filing the application.
2. Solution
After conducting a patent search, we found that a product using similar technology already exists. In this situation, we have no choice but to conclude that Company A’s invention does not have inventive step. However, we believe that there is plenty of room for improvement. Therefore, we proposed to Company A that they apply for a patent as a new invention with inventive step based on their current invention and further ingenuity.
Possible solutions include clarifying the differences with existing patents, adding new features and effects, adding unique functions, and incorporating innovative elements to differentiate from existing tableware.
Adding data with inventive step and making more specific changes to the structure and shape will increase the chances of being recognized as novel and inventive.
