1. Content of consultation
A company wants to develop a new business separate from its core business by combining a business conceived by an employee of Company A with Company A’s existing processing technology. We consulted with the client to obtain trademark rights for the name of the business to enhance its brand power and differentiate it from other companies. In addition, in preparing a business plan for the new business, the client asked whether there was any possibility of trademark infringement and under which category of trademark the new business would fall (i.e., into which group of trademarks the products or services would fall).
2.Solution
We conducted a prior trademark search for Company A’s products, confirmed that there were no business problems, and examined the trademark classifications. We also provided support in drafting a business plan that would appeal to Company A’s unique strengths.
3. Conclusion
Our firm found that Company A’s products fall into several categories. When registering a trademark, the fee is determined by the classification. We explained the detailed fee structure to Company A and recommended that they register their trademark in one of the classes.
