クライアントの海外メーカーA社はABC（仮名）という言葉を使って、日本で何かサービスをしたいと考えていました。A社が独自に調査をしたところ、先に国際登録商標で他社が先に日本で商標を取得していました。そういう状況の中で、どうしたら取得できるかとのご相談がありました。
解決策の提案
一つの提案として不使用取消審判をA社にご提案しました。それは、海外の企業が日本で商標を取得する場合、日本で使用をしていない可能性が考えられるからです。そこで、権利者である他社の使用状況（日本で使った形跡があるかどうか）を調査しました。
結論
調査の結果、現在日本でも使用していることが分かったため、不使用取消審判を断念しました。A社がABCという言葉をどうしても使用したいというご希望があるのであれば、〇〇ABCのように前に言葉を付けたり（〇〇は、例えば、NEWやPro等）、ABC△△のように後ろに言葉を付けたりして（△△は、例えば、NowやGreat等）、識別力を付けて、登録商標と差別化して権利化したらどうかとおすすめしました。

1. Content of consultation
The client, overseas manufacturer A, wanted to provide some kind of service in Japan using the word ABC (pseudonym). Company A conducted its own investigation and found that it was an internationally registered trademark and another company had acquired the trademark in Japan first. In such a situation, I was asked how I could obtain one.
2. Solution
We proposed Company A to file a trial for cancellation of non-use as one solution. This was because when a foreign company acquires a trademark in Japan, there is a possibility that the trademark is not used in Japan. Therefore, we investigated the use of the trademark by the right holder, another company (whether or not there was any evidence of use in Japan).
3. Conclusion
If Company A insists on using the word ABC, it is possible to add a word in front of the word, such as 〇〇ABC (〇〇is for example, NEW or Pro, etc.) or after the word, such as ABC△△△ (where “△” is a word that is used after the word). (△△ is for example, Now, Great, etc.) to add distinctiveness and differentiate the trademark from registered trademarks.
