拒絶理由通知対応（食品容器）

クライアントは、新規に開発した食器容器について特許出願を行いましたが、特許庁から進歩性欠如を理由とする拒絶理由通知を受け、弊所に相談されました。

拒絶理由通知に引用された文献と本発明を比較し、
・引用文献には記載がなく、
・本願の出願当初明細書に明確に記載されている構成要件
を特定しました。
その構成要件を請求項に追加する補正を行い、さらに意見書において、
・引用文献には当該構成が存在しないこと
・追加した構成によって、引用文献の発明には見られない新たな効果が得られること
を論理的に説明しました。
この対応により、拒絶理由は解消されると考えられるため、補正書及び意見書を検討しました。

特許出願において進歩性を理由とする拒絶理由通知を受けた場合は、
・出願当初明細書に、引用文献にない事項が存在するかを確認する
・その事項が有利な効果をもたらすかを検討する
・請求項を補正し、その効果を意見書で明確に主張する

Our client filed a patent application for a newly developed tableware container, but received a notice of rejection from the Japan Patent Office citing lack of inventive step. They consulted us.

2. Solution
We compared the present invention with the references cited in the rejection notice and identified features that were not mentioned in the cited references but were clearly stated in the original specification of the application.
We filed an amendment to add these features to the claims, and in our written argument, we logically explained that:

These features are not present in the cited references.
The added features achieve new effects not found in the inventions in the cited references.
We believe this approach overcomes the rejection, so we submitted an amendment and an argument.

3. Conclusion
