クライアントは、過去に食品加工に関する発明について特許権を取得していました。今回、当該発明に関連する改良発明の検討を行うにあたり、既存技術の動向を把握し、研究開発の方向性を明確にするため、当所に先行技術文献調査を依頼されました。
解決策の提案
当所では、改良発明の検討に資する情報を幅広く収集するため、以下の調査を実施しました。

1. Consultation Details
The client previously obtained a patent for an invention related to food processing. In considering an improved invention related to that invention, the client requested our firm to conduct a prior art literature search to understand trends in existing technology and clarify the direction of research and development.
2. Solution
To gather a wide range of information useful for considering the improved invention, our firm conducted the following research:
– Online search of non-patent literature (papers, technical documents, etc.)
– Patent document search using the Japan Patent Office’s patent information platform, J-PlatPat
As a result, we discovered several documents that were published after the client’s previous patent application and indicated new technological trends related to food processing.
A comprehensive analysis of these documents suggested that in order to establish an improved invention, it would be effective to consider the following technical considerations:
– Not being limited to the processing details described in the existing patent
– Consideration of alternative processing methods
– Consideration of the incorporation of new ingredients or changes to processing conditions
We collated the results of these analyses and reported them to the client, who used them as concrete guidelines for considering the improved invention.
