株式会社A様より、「名称B」について商標登録が可能かどうかのご相談をいただきました。

当所では、名称Bが商標としての識別力を有しているか、および既に同様の商標が出願・登録されていないかを、特許庁の公式データベース「J-PlatPat」を用いて徹底調査いたしました。
まず、名称B単体での検索では、該当する既存の商標は見当たりませんでした。
次に、名称Bの構成要素に注目し、「語句Cで始まり語句Dで終わる名称」として検索したところ、いくつかの類似商標がヒット。その中にはすでに登録されている例も確認できたため、名称Bも十分な識別力を有する商標と判断できます。
さらに、類似の商標が他社により出願されていないことから、名称Bでの商標登録の可能性は非常に高いと考えられます。

A Co., Ltd. asked us if it was possible to register “Name B” as a trademark.

2. Key points of research and analysis
We conducted a thorough research using the Japan Patent Office’s official database “J-PlatPat” to determine whether Name B has distinctiveness as a trademark and whether a similar trademark has already been applied for or registered.

First, a search for Name B alone did not find any existing trademarks that matched the search.

Next, we focused on the components of Name B and searched for “names starting with phrase C and ending with phrase D,” which resulted in several similar trademarks. Some of these were already registered, so Name B can be judged to be a trademark with sufficient distinctiveness.

Furthermore, since no similar trademarks have been applied for by other companies, the possibility of registering Name B as a trademark is considered to be very high.
